Changes to your Tenancy

You may have a request for a change to a tenancy for a variety of reasons. Our staff will speak to you to discuss any requirements and ensure you are provided with the relevant legal advice and support.

Typical requests to change a tenancy include:

- Ending your tenancy
- Adding someone to your tenancy
- Taking over the tenancy following the death of the tenant (succession)

Questions about tenancy changes

Why might I request a change to my tenancy?

You may need to make a change to your tenancy for several reasons, such as a name change, adding someone to the tenancy, taking over a tenancy after a tenant has died, or assigning your tenancy to another person. A member of staff will discuss your request with you and ensure you receive the correct legal advice and support.

How do I request a name change on my tenancy?

To request a name change, email lettings@wvht.co.uk with the reason for the change and the relevant supporting documents. Acceptable documents include:

  • A copy of your marriage or civil partnership certificate
  • A copy of your divorce or dissolution certificate
  • A copy of deed poll documentation

Once your request and documentation are received, a member of staff will contact you to discuss next steps.

How do I add someone to my tenancy (change from sole to joint)?

If you wish to convert your tenancy from a sole to a joint tenancy, contact the Lettings Team at lettings@wvht.co.uk. Your request should include:

  • The reason for requesting a joint tenancy
  • The relationship of the person you want to add
  • How long they have lived at the property

Staff will review your eligibility based on your current tenancy type and any previous changes.

What is ‘succession,’ and who can take over a tenancy when a tenant dies?

Some individuals have a legal right to take over (succeed to) a tenancy after the tenant’s death. Eligibility depends on the tenancy type and your relationship to the deceased.

There can only be one succession per tenancy. The three types of succession are:

1. Survivorship

If the tenancy was joint, it may automatically pass to the surviving joint tenant.

2. Statutory succession

Applies if:

  • You were the tenant’s spouse or civil partner
  • Or lived with them as though you were
  • AND the property was your only or main home immediately before their death

3. Contractual succession

Applies if:

  • You were a family member
  • AND lived with the tenant for at least 12 months prior to their death
How do I request succession?

Email lettings@wvht.co.uk with a written request including:

  • Date of death
  • Your relationship to the tenant
  • How long you lived at the property
  • Details of anyone else still living in the property
  • A copy of the death certificate (if unavailable, send it as soon as you can later)
  • Your contact details
  • Any helpful supporting information (e.g., electoral registration details to speed up verification)

Staff will then assess your eligibility and advise you about your legal rights.

What if I am not eligible to succeed to the tenancy?

If there is no legal right to succession, staff must serve a legal notice to end the tenancy. However, they will work sensitively with you to consider your circumstances and provide advice and support.

How do I assign (transfer) my tenancy to another person?

Assignment means transferring your tenancy to someone else. To request this, write to lettings@wvht.co.uk, including:

  • Your reasons for requesting an assignment
  • Who you wish to assign the tenancy to
  • Their relationship to you
  • How long they have lived at the property

Not all requests can be approved. Staff will review your tenancy agreement and provide the necessary advice.
